Renewable Fuel Standard Mandate Stands

The Environmental Protection Agency has decided to not waive the Renewable Fuel Standard mandate for corn-based ethanol. In the wake of this year's extreme drought, the National Restaurant Association and others had argued that the federal government should grant the temporary waiver so that more corn could be used to bolster the food supply.

House Bill 2033, passed during the 82nd Regular Session in 2011, allows a mixed beverage permittee to add a separate statement on a customer’s invoice, bill or other receipt that discloses the amount of mixed beverage tax to be paid by the permittee on that sale. The tax disclosure statement is intended to be informational purposes only.

Changing the Mixed Beverage Tax to a Sales Tax

The Texas Restaurant Association plans to seek legislation in the upcoming Legislative Session to change the mixed beverage tax to a sales tax. In the last session, we passed a bill allowing for the disclosure of the 14% mixed beverage tax on a customer's receipt. While tax transparency is important, we'd like to change the incident of the tax from the seller to the purchaser to more closely follow our existing sales tax structure.
